Press Release on the Issuance of the WTO Arbitration Award in the Dispute United States — Countervailing Duty Measures on Certain Products from China (Recourse to Article 22.6 of the DSU by the United States)

On January 26, 2022, the WTO arbitration tribunal in the dispute United States — Countervailing Duty Measures on Certain Products from China (Recourse to Article 22.6 of the DSU by the United States) issued its award, determining that China may impose trade retaliation against the United States with respect to trade in goods in the amount of USD 645 million annually due to the failure by the United States to comply with a WTO ruling in force. This dispute counts the second time where China has been authorized to impose trade retaliation against the United States in the WTO. Previously, in another WTO dispute challenging certain anti-dumping measures of the United States, China was authorized to impose trade retaliation against the United States in the annual amount of USD 3,579 million.

This WTO award once again proves that the United States has violated the WTO rules, abused trade remedy measures, refused to implement WTO rulings and international obligations clearly specified in the WTO rules, and seriously damaged the fair and just international trade environment. China urges the United States to stop seeking any excuses and take immediate actions to correct its wrongful conducts in trade remedy investigations targeting China.

China attaches great importance to the positive role of the international rule of law in stabilizing the international economic and trade order and regulating international economic and trade relations. China will pay close attention to subsequent implementation measures by the United States and reserves the right to take further actions to safeguard the authority of the multilateral trading system.
